    Rusape to be a municipality by 2020 – new chairman

    RUSAPE   -   A teacher at Handina Secondary School in Nyazura has been cleared of a charge of sodomising a lower sixth pupil who was staying at his house.
    Magistrate Livingstone Chipadza of Rusape ruled two weeks ago that the complaint did not give enough evidence to nail Muhammed Kambanga (40) of Vengere Rusape. 
    Kambanga who pleaded not guilty was represented by Maxwell Chiwanza of Chiwanza and Partners. The complainant is an 18-year-old pupil who stayed at Handina Secondary school but attended Lower 6th at Rukweza High school, Nyazura.
    It is the State case that on March 14, 2018 the accused and the complainant were asleep in the same room at the accused's residence. The accused touched the complainant's head and proposed love to him. This surprised the complainant who did not answer.
    The State alleged that the accused fondled the complainant and the complainant objected but the accused went on to fondle the boy's manhood
    The State said on March 15 at around 9pm the accused and the complainant went to sleep as usual and the complainant refused to sleep on the bed. At midnight the complainant woke up and discovered that the accused person was naked and had stripped the complainant naked without noticing it and then had sexual intercourse with him through his anus and ejaculated without his consent. 
    The complainant allegedly realised that there was semen on his hand and all over the blankets. The accused took his towel and cleaned the complainant. 
    The complainant reported the matter to the school head leading to the arrest of the accused.
    Magistrate Chipadza ruled that the accused's defence was more sensible than the complainant's outline. He said that the complainant fabricated the story because he wanted his uncle who is his guardian to transfer him to a school in Harare. However the uncle found Harare schools expensive. 
    Magistrate Chipadza wondered why the complainant did not report the sexual abuse to his aunt who is a teacher at the school. He concluded by saying that the complainant no longer wanted to travel the long distance to Rukweza so he decided to formulate the story so that he could go to Harare.
