    74-year-old escapes rape charge

    CHIVI – Children of 74-year-old Gibson Damba from Madyangove Village under Headman Madamombe in Chivi were relieved at the Masvingo Magistrates Court two weeks ago when their father was acquitted of a rape charge.
    Damba was dragged to court on a charge of raping a 16-year-old girl from the neighbourhood in 2016.
    However, it turned out that the complainant was having an affair with a local Policeman at Mashava base. On the fateful day the complainant had sex with the cop in the bush but realised as they left the love nest that someone was watching them. 
    The complainant rushed home and claimed that she had been raped by someone whom she didn't recognise but was wearing a long jacket. The court was told that it was then that the girl's two uncles identified Damba as the suspect.
    "Hlupeko Dhova and Mukoko who are the complainant's uncles forced the girl to accuse my father just because they saw him wearing a long jacket and passing by the scene where the girl claimed she was raped.
    "Dhova and Mukoko wanted us to settle this matter out of court by paying them. They know that the Damba family has money but we refused to the out of court settlement because we knew that our father could not have done such rubbish," said Henry Damba, a son to the accused.
    Gibson Damba was represented by Omen Mafa of Shumba Mutendi Legal Practitioners.
