    Lawyer sues Zanu PF, Econet over privacy



    •    Ruling party ready to go to court

    MASVINGO - Omen Mafa, a lawyer with Mutendi, Mudisi and Shumba has applied to the High Court for declaratory that Zanu PF's move to send unsolicited mobile phone campaign messages to registered voters is unlawful.
    He argues that the behaviour by the ruling party is a violation of his right to privacy.
    Mafa who is not a Zanu PF member says in his court application that he recently received mobile messages from the ruling party's Parliamentary candidate for Gutu West John Paradza urging him to vote for the latter and the party's presidential candidate Emmerson Mnangagwa in the 2018 national elections due on July 30.
    He is therefore suing Econet as the first respondent, Zanu PF as the second respondent, Zimbabwe Electoral Commission (ZEC) as the third and Paradza as the fourth.
    Zanu PF spokesperson Simon Khaya Moyo said Zanu PF is ready to meet the lawyer in court. He however, said Mafa has a democratic right to sue anyone but targeting the party was misplaced. He said the lawyer should have sued the aspiring MP who sent him the messages and not Zanu PF.
    Mafa who submitted his application at Masvingo High Court on July 10 2018 said Zanu PF campaign messages were a violation of his right to privacy and accused Econet of facilitating such violation. He accused ZEC of providing personal information to Zanu PF without his consent.
    The four respondents have 10 days to respond to the application. Efforts to get a comment from Zanu PF sp[okesperson
    "The purported conduct of Econet infringes my constitutional right to personal privacy in that the mobile services company had no mandate to provide its subscriber databases to third parties without my consent," read the court application.
    The High Court can declare the practice by Zanu PF legal or illegal. If it's declared illegal it means any political party can be sued for damages on future infringements. If the practice is declared lawful then parties will be free to send their campaign material to individuals.
