    Pote wins case against landlord

    SYDNEY NCUBE

ZVISHAVANE - Prominent Zvishavane business mogul Clever Anthony Pote has won a court case brought against him by his landlord Michael Timveous of Acropol.
His landlord wanted him to pay $9 000 for a damaged window pane and a few floor tiles that peeled off.
Pote has from 2014 been renting a shop owned by Acropol which is situated at Building number 97 R G Mugabe way Macarios in Zvishavane and used it as a warehouse for his imported goods. He paid a security deposit of $2 500 for the building.
Recently the landlord discovered that 20 square metres tiles of a total of 60 square metres were damaged and so was a window pane at the French door. Acropol immediately filed a seven-day notice summon against Pote's Makanaka Investments for breach of contract and demanded $6 7987,33  .
Acropol was represented by Leopold Mudisi of Mutendi, Mudisi and Shumba Legal Practitioners and Eleni Timveous was at the courts.
Makanaka Investmenets argued in court that the claimed damages were out of this world. The company argued that the total amount of money demanded by Acropol came to $9 298, 33 if one added the damages plus the security deposit.
Magistrate Shephard Mjanja dismissed the damages claim and said the security deposit was enough to cater for required repairs. Pote has since vacated the building.
