    Buhera man gets 1 ½ years for bedding minor


    BUHERA – A 21 -year- old man from Mukwasi Village, Chief Nyashanu in Buhera has been sentenced to 18 months in prison or 420 hours of community service for bedding a minor aged 13 years on three different occasions.
    On one of the occasions, the accused spent the whole night with the minor at his place.
    Kudzai Chaibva (21) on June 29, 2017 unlawfully had sexual intercourse with the girl who is incapable of consenting to sexual intercourse.
    Six months of the sentence were set aside for 5 years on condition he doesn't commit a similar offence.
    Giving sentence, Magistrate Dennis Mangosi said he had considered that it was the accused's first offence and the medical report indicated that the complainant was not HIV positive.
    On a day unknown to the prosecutor in May, 2017, Chaibva proposed love to the complainant and on June 29, 2017 the accused person took the complainant to his mother's house where the two had sexual intercourse once.
    The incident occurred in Chiteeri village under Chief Nyashanu.
    On the second count, at around 9am the accused took the complainant to his grandmother's home and had sexual intercourse with her once.
    On the third count, Chaibva on July 7, 2017 in Chiteeri village had sexual intercourse with the same 13 year old juvenile.
    Here it is said that the complainant went to the accused person's homestead where she slept and the two are said to have had consensual sexual intercourse once.
    The case came to light after the complainant was quizzed by her aunt RosemaryMbaimbai after she hadfailed to come home the whole night.
    The complainant was then examined at Murambinda Mission Hospital and the medical report was produced in court as an exhibit.
