CHIREDZI – Jane Hwarare, the wife of prominent Chiredzi trade unionist cum politician, Rtd Captain Admore Hwarare is suing her husband's girlfriend for $100 000 in adultery damages.
She filed the lawsuit at the Masvingo High Court on Tuesday last week.
Jane says in her court papers that she lost conjugal rights from her husband as a result of the relationship that Josephene Chavani had with her husband. Her husband also spent a lot of money on Chavani.
Jane says she has not been enjoying conjugal rights from 2011 to date as her husband had moved in with Chavani.
The lawsuit came only a week after Chavani approached Chiredzi Magistrate`s Court seeking a protection order that will bar Hwarare from visiting her house.
According to the summons case number HC29/16 prepared by Saratoga Makausi Legal Practitioners and filed at Masvingo High Court on October 25, 2016, Jane says she is legally married to Hwarare in terms of Marriages Act Chapter 5:11.
She said between 2011 and 2016 Chavani has been committing adultery with her husband. They committed the adultery in Chiredzi and various holiday resorts in Zimbabwe and the two would also go out of the country.
She says that Chavani committed the offence fully aware that her husband was married and was a family man and she personally knew her.
"As a result of the adultery the Plaintiff`s husband abandoned the matrimonial home and started residing with Chavani. Her husband also neglected her, denied her conjugal rights and spent all his finances on Chavani`s needs and happiness. As a result of the adulterous relationship the Plaintiff suffered damages in the sum of $100 000 which we are now claiming" reads the court papers.
