    Court acquits footballer of rape

    CHIREDZI – Former Chiredzi FC player David Sengu who was facing charges of raping a 14-year-old girl is now a free man after the court acquitted him of all the three counts he was facing.
    Sengu appeared for ruling before Chiredzi Regional Magistrate Judith Zuyu last week.
    Appearing for the State Moreblessing Rusere told the court that on three occasions during the month of November 2015 Sengu would take advantage of the absence of the minor`s aunt who is Sengu`s wife to force himself on her while wielding a knife. The State alleged that on an unknown date but in November 2015 the minor was with her aunt doing household chores. Her aunt went to an unknown place leaving her in the company of Sengu. Sengu approached her and pinned her down, removed her clothes and raped her.
    On another day while cleaning the house he approached her, pushed her to the floor and raped her. The State alleged that on all these occasions Sengu used a cloth to cover the girl's mouth so that she could not cry out and on another occasion he kissed her heavily that her voice could not come out.
    Through his lawyer, Wellington Muzenda of Muzenda and Chitsama Legal Practitioners, Sengu denied all allegations. Muzenda argued that the State failed to discharge its onus to prove its case beyond any reasonable doubt. He said the contradictions and inconsistencies in the minor`s statements cast doubt that must benefit his client.
    Muzenda also argued that the report was not timeously made and it only came after pressure was exerted on the minor and it was also not voluntary.
    Magistrate Zuyu concurred with the defence counsel and acquitted Sengu on all three charges.
