    Magistrate recuses self as Prosecutor is accused of demanding $1 000 bribe

    A matter between Zesa and employees of Country Planning Bakery has been referred from Gutu Magistrates' Court to Masvingo allegedly because the prosecutor in the case demanded $1 000 bribe, The Mirror has been informed.
    Gutu Magistrate Edwin Marecha 'transferred the case to another court' on Monday this week after two accused Tendai Nyakabau (50) and Veronica Kavhita appeared in court facing charges of diverting power from Zesa lines with a view to avoid bills.
    The two are being represented by Philip Shumba of Mutendi and Shumba Legal Practitioners. Shumba did not comment on the matter although he promised to get back to The Mirror.
    The allegations are that the involved prosecutor demanded $1 000 bribe from the accused who are on $200 bail. Documents seen by The Mirror indicate that the Magistrate gave his reasons for transferring the case as professional.
    Police spokesperson Inspector Charity Mazula said she cannot comment on the matter since it is now in the courts. She however, said that had not  received any report against the accused prosecutor.
    The Mirror is reliably informed that the complainants applied for recusal by the court as they no longer had confidence in it after the demand for bribe.
    The allegations against the two who are based at Mpandawana are that they disconnected electric cables which were connected to a recording metre and bypassed the cables to facilitate the use of electric current without charges.
    The third accused Takudzwa Kativhu is still at large. The offence came to light on May 4, 2016 when a Zesa loss control officer inspected the premises at the bakery and realised that cables were illegally abridged to facilitate the use of power without charges.
    When confronted by the officer Nyakabau implicated Kativhu who is on the run. Kavhita is the owner of the bakery, according to court documents.
