    MASVINGO
    – A former Zanu PF councillor in the Bhuka area of Masvingo Kenneth Tachiona Chiminya was on Tuesday acquitted of theft by Masvingo Magistrate  Sibongile Mkandla.
Chiminya was represented by Mutendi and Shumba Legal Practitioners.
Chiminya was detained for two nights at Chikato Police Station after being arrested on allegations of fraud. The charge was later changed to theft.
However, tampers flared at the court after Tawanda Tasah who was a complainant in the case protested against what he said was an unfair trial of the case.
    Josuah Mundondo prosecuted.
Tasah said he was surprised that Chiminya was acquitted without any hearing having taken place in the court. He said this is despite that the case had been dragging at the courts since December.
He said the case was postponed many times, once in December last year, once in January, once in February, twice in March and three times in April this year.
"We went into court and without me or any of my witnesses presenting any evidence we were told that that Chiminya was acquitted. I wasted a lot of my money bringing witnesses from many times to the courts," said Tasah
It was the State case that Chiminya received $890 from Tasah after agreeing that he would supply the later who is a businessman in Mucheke with double chip frier. It is alleged that the chip frier was never supplied leading to the arrest of Chiminya.
The Mirror understands that Tasah has since raised his complaint with Ellison Chanakira the area prosecutor for Masvingo.local news
