    City Council loses yet another labour case


    – Masvingo City Council whose human resources management record is not impressive has lost yet another labour case after attempts to dismiss two senior members of the workers' committee were thrown out by a labour officer.
    In a ruling passed by Gutu Labour officer, Faith Mupangani on Wednesday last week, Council was ordered to reinstate Bonface Mazarire and Vunganai Manasseh who the council fired last year on a three months notice.
    Mazarire and Manasseh who hold positions as workers' committee chairman and Zimbabwe Urban Councils' Workers' Union vice chairman respectively, were reinstated without loss of salary or benefit and the City Council is required to comply with the ruling within 30 days.
    The duo was represented by Matsikidze and Mucheche Law Chambers while Masvingo City Council was represented by Saratoga Makausi Law Chambers.
    Although the two argued that they were fired because they held positions in the workers' committee where they had caused problems for management including being on the forefront of a labour case where workers are fighting for $3,5 million in back pays, the labour officer declared that there was no victimisation.
    He however, declared that the duo's contracts were unfairly terminated although there was no unfair dismissal.
    Mupangani gave his reason for declaring an unfair termination of contract as being that the termination contradicted with the provisions of section 12 (4a) of the Act. He said the new enactment had clearly invalidated all terminations of employment contracts that were merely done on notice, on or after July 17, 2015.
    The council was given an option to negotiate a retrenchment package with the workers if reinstatement was no longer an option.
    The dismissals of these two workers plus a third one caused serious division in council after Mayor Hubert Fidze protested against the move and refused to chair the meeting that resolved for the dismissal. The meeting ended up being chaired by Ward 10 councillor Lovemore Mufamba who is not even a deputy mayor.local news
