MDC administrator acquitted for distributing demo fliers

MASVINGO – MDC Alliance’s administrator for Masvingo Province, Peter Chigaba (43) has been acquitted on a charge brought against him for distributing fliers calling upon residents of the city to demonstrate against the collapsing economy.
Chigaba who is also a former bodyguard of the late Prime Minister, Morgan Tsvangirai was charged for contravening the Public Order and Security Act (POSA).
His case was brought before Masvingo Magistrate, Godswill Mavenge.
Chigaba who was represented by Collen Maboke of Ruvengo, Maboke and Company Legal Practitioners was cleared of the charges on Friday after Magistrate Mavenge said the State’s two witnesses who are Police officers gave conflicting evidence.
Chigaba was accused of inducing and persuading residents to participate in an MDC organised demonstration that was set for August 21, 2019 without clearance from the Police.
Police constable Mafa and Detective Sergeant Muyambo gave conflicting statements with Mafa saying they saw Chigaba distributing fliers for the demo at Ace Garage in the City before he boarded an unregistered silver Mercedes Benz and sped off from the scene while Nyoka said they saw him distributing fliers and summoned him to the Police station where he was arrested.
“The witnesses gave conflicting testimonies and the State case does not hold enough evidence to hold a trial, the matter is dismissed and you (Chigaba) have been cleared of the charges,” said Magistrate Mavenge.
