    High Court dismisses Chiredzi Zimra boss appeal


    CHIREDZI - Masvingo High Court has dismissed an appeal against both conviction and sentence lodged by Lloyd Mubingi, the Zimra boss at Chiredzi after he failed to file heads of arguments on time.
    Mubingi was convicted by Chiredzi Magistrate Richard Mawarire on December 21, 2018 for verbally assaulting his subordinate Joseph Mutezo during a phone call sometime last year and he was ordered to pay $50 fine or 14 days imprisonment.
    Masvingo Registrar of High Court wrote to Mubingi’s lawyers Kwirira and Magwaliba that the attorneys failed to file heads of arguments as required by the 6th of May 2019 hence the dismissal of the appeal.
    “I refer to a letter of the April 10, 2019 in which you were called upon to file heads of arguments by May 6, 2019 up to now no such heads of arguments have been received. Accordingly, the appeal shall be deemed abandoned and dismissed. By a copy of this letter records are returned to court of origin to enable the respondent to execute the judgement appealed against,” reads the letter.
    The Mirror understands that Mubingi has since been transferred from Chiredzi to Masvingo.
