GWANDA - A man from Gwanda felt a deep sense of loss after a commercial sex worker sold his cellphone and an open view decoder to recover a $50 debt emanating from a one-night stand.
Mlamuli Ben (35) of house number 41, Section 3, Collen Bawn gave the two gadgets with a value of $400 to the sex worker as guarantee for the debt in case he failed to pay for the sex services within three days.
Priviledge Moyo (32) who regularly provided service to Mlamuli sold the gadgets after the agreed period lapsed. With a deep sense of loss, Mlamuli hatched a plan and reported Moyo to the Police for breaking into his unlocked house and stealing the open view decoder, one cellphone, 1 litre cooking oil and a wallet containing US$20, ZAR 100 and $6 bond notes.
Mlamuli’s plot however, hit against a brick wall when Moyo brought witnesses to Gwanda Magistrates Court and convinced Magistrate magistrate Edmund Moyo that she did not steal anything from the complainant. The witnesses including the accused’s landlord Vusumuzi Siwela managed to tell the court that the two had a client-service provider relationship and indeed they both spent the night in question at Mlamuli’s house on the day in question, not stealing any gadgets but enjoying each other’s company.
Magistrate Moyo rapped the complainant for abusing the courts for personal gain and warned him against the practice. He acquitted Moyo.
Prosecutor Glender Nare said on November 11, 2018 at 1030pm, the accused broke through the complainant’s unlocked door and stole various items.
She sold the open view decoder to a neighbor who informed the complainant. The decoder was recovered by the Police and accused was arrested. A Samsung cellphone was also recovered from the accused.
Moyo said there was no way she could have kept the gadgets as she had spent the night with the complainant hoping to get cash. She said after three days, she had no reason to keep the gadgets but to sell them to get her cash.
