MVUMA - A man who is desperate to recover his cattle impounded by Chief Chirumanzu in violation of a High Court order against the Chief has appealed to Mvuma Magistrate Courts for assistance.
Siselani Chiradza of Chiradza Village had a ruling against him by Chief Chirumanzu and Chief thereafter impounded his two beasts.
Chiradza Appealed to the Mvuma Magistrates Court and Chief Chirumanzu's ruling was overturned. Chief Chirumanzu however, appealed to the High Court and Justices Muremba and Matandamoyo upheld the magistrate's ruling.
Chivhu messenger of court was then tasked to attach Chief Chirumanzu's property in order for the applicant to recover his beasts or their value.
Chiradza has since written a letter of complaint to Mvuma Magistrate against the messenger of court whom he accuses of failing to attach any property from the chief since July 4 2018. In the letter to magistrate Tafadzwa Mhlanga he accuses the messenger of court of being impartial.
"The warrant of delivery is for the cattle according to the order granted. The respondent has quite a herd of cattle but the messenger is failing to execute on it or is intermittent on their allies.
"Whereof I pray that messenger of court be enforced to execute his duties diligently and impartially," read part of the letter.
