    Mutangiri takes liquidator to court over Mutema business properties

    •  Chivhu businessman faces perjury

    CHIKOMBA – Prominent Masvingo Businessman, Philmon Mutangiri has pressed perjury charges against a Chivhu businessman and liquidator who allegedly lied under oath on a sales agreement involving a $106 000 building in Bikita.
    The perjury trial is before Magistrate Henry Sande at Chivhu and the ruling will be made on December 6 2017.
    The allegations are that the liquidator, Jeremiah Matenhese who is also the director of Polka Executor Services  a Chivhu based company is the liquidator of Mutema Brothers Private Limited that became insolvent.
    The court was told that Matenhese then sold a building at Nyika Growth Point to Mutangiri at a cost of $106 000 and Mutangiri paid $100 000. The sale went through in May last year and the money was paid to the principal creditor Interfin Bank.
    Matenhese is represented by Frank Chirairo of Saratoga and Makausi Law Chambers. 
    It is alleged that the agreement allowed Mutangiri to take occupancy of the building after payment of $100 000 and that the balance was supposed to be paid by one of the complainant's tenants, Leornard Mutema under an arrangement. 
    The court however, heard that at some stage Mutema stopped fulfilling his financial obligations to Mutangiri and the complainant closed Mutema's shops at the building in a bid to force him to pay the money that he owed.
    On August 23 2017, Mutangiri closed Mutema's operations at the building that included a butchery, bakery and take-away.
    As Mutangiri tried to remove Mutema, Matenhese wrote an affidavit to the courts to the effect that Mutangiri had not been authorised to occupy the building and therefore had no powers to remove Mutema.
    However, Mutangiri insists that the agreement of sale allowed him to occupy the building after paying $100 000 and accuses Matenhese of lying through his affidavit.
