    Buhera teacher refutes allegations of raping Grade 6 pupil

    BUHERA - A 44-year-old teacher from Dzaramba Primary School in Buhera accused of raping an 11-year Grade 6 pupil on the classroom floor has refuted the allegations and said that the girl mentioned his name under duress.
    Admire Tivakudze from Zvotoona Village under Chief Nyashanu appeared before Rusape Magistrate Livingstone Chipadza last Friday and is represented by Leornad Chigadza of Chigadza and Associates.
    The complainant who is now doing grade 7 stays in Kuvarairwa Village under Chief Nyashanu.
    Chigadza insisted that his client did not commit the crime but the issue arose after parents in the community suspected that there was a teacher in the school who was having sex with the girl.
    He said that the parents' meeting actually mentioned another teacher by the name Edmore Nyamukapa as the suspect and he said there were minutes at the school to that effect.
    Chigadza added that the accused name was never mentioned in that parents meeting.
    He said the accused name only arose at the Murambinda One Stop Centre after the complainant was threatened by a Police officer that a doctor would know what happened even if she lied.
    He said initially all the girls taken to One Stop Centre refuted the allegations that they were raped.
    The girl however, insisted in court that the accused raped her.
    She said the incident occurred during lunchtime. She said she was with a friend (name withheld) and decided that they should go in the classroom and write their content notes.
    She said her friend finished copying the notes first and she went out living her alone with the accused person. That is when the accused came to her, dragged her behind the door in the classroom and had sexual intercourse with her with the door half closed.
    She said the accused threatened her with death if she told anyone.
    When the defense lawyer asked whether that it was her first time to have sex with a man, the complainant said yes but said she did not bleed and her uniform did not get spoiled.
    Chigadza told the Court that the complainant actually had sex with the other teacher Nyamukapa during the April holidays and that he asked the other children who were at the borehole to leave so that he could be left alone with the complainant. He went on to say that inspectors from the District Education offices came to investigate the issue that the complainant was raped by a teacher called Nyamukapa.
    He said that it was not true that the complainant was raped by the accused because she could not remember the day it was, the time or the month she was raped. He said she only mentioned the name of the accused because Police had told her that the doctor will see if she was still a virgin or not.
