MASVINGO – Prominent Masvingo businessman, Aubrey Cummings appeared in court on Monday facing three counts of rape involving a minor who was 11 when the crime was first committed.
The minor who is now 16 and doing form four is Cummings' granddaughter, according to the State outline.
Cummings is denying the charge.
The trial which kicked off on Monday this week is being held in camera and everybody including journalists, the mother of the girl and relatives were ordered to leave the court soon after the State outline was read out.
The allegations are that Cummings raped his granddaughter from 2012 to September 2016 and the crime was committed at his house in Rhodhene and at one time in the businessman's car along Masvingo-Mashava Road.
The matter is being heard by Regional Magistrate Dambudzo Malunga and Mukai Mutumhe is representing the State.
It is the State case that Cummings and the complainant stayed at the same house in Rhodhe and on a date unknown to the Prosecutor but during the month of August 2012, the accused entered the complainant's room around 3am. He dragged blankets from the complainant, allegedly pulled her night dress up before removing her pant and raping her.
It is the State case that the complainant told the accused's former housemaid after she had seen her crying.
The State further alleges that in May 2014, the accused again entered his granddaughter's room and raped her in the same manner as in the first count.
On September 3, 2016 the complainant allegedly went to collect money for her uniforms from the accused in town. When the complainant entered the car the accused allegedly drove off towards Bulawayo Road and after about 9km drove into a dust road and parked.
The accused then moved to the back seat where the complainant was sitting and allegedly raped her once. The complainant sent a text message to her mother informing her that she had been raped.
The matter was reported to the Police the following day.crime news
