CHIVHU - Kwenda High School teacher Marjorie Mhaka (29) who stays in Chivhu was recently assaulted in public by her ex-husband, Onias Moyo for allegedly talking to a male friend.
Resident Magistrate Story Rushambwa has since sentenced Moyo to 12 months for the assault and suspended three months of the sentenced for five years. Moyo assaulted his ex-wife despite that Mhaka enjoyed protection through a peace order.
Moyo was found guilty of contravening Section 10 (7) of the domestic violence Act chapter 5:16 : "Failure to comply with terms and conditions of a protection order"
Sources said Moyo is insisting that he found his former wife Mhaka being kissed by Mupumha at Pick 'n' Pay on the day he assaulted her.
It is the State case that on December 25, at around 7pm, the complainant (Mhaka) was in Chivhu and the accused saw her communicating with her male friend, Mupumha and slapped her once on the cheek, accusing her of having a love affair with Mupumha.
The complainant drove her motor vehicle away and when she arrived home she told her brother Simbarashe Mhaka who then accompanied her to Chivhu Police. Whilst they were on their way, the accused person followed them and blocked their way at Exor junction using his vehicle BMW X5, silver in colour. The complainant parked her vehicle and asked why the accused was blocking their way.
Moyo then insulted the complainant, grabbed her hair through the open window, assaulted her several times on the face and banged her head against the steering wheel.
The complainant's brother sought for help and the accused person drove away from the scene. The complainant reported the matter at Chivhu Police Station. She sustained swollen lips and was medically examined.
Sometime in March this year, the complainant applied for a protection order against the accused person and was ordered not to assault, insult or harass the complainant and was granted on April 15 at Chivhu Civil Court.
