GWANDA - 19-year-old Dylan Ndlovu of Mahetshe Village in Maphisa in Gwanda who was facing charges of raping a 56-year old Zanu PF MP was on Tuesday found not guilty and acquitted.
Regional Magistrate Mark Dzira said the witnesses failed to convince the court.
"Nosizo told the court that she knew the accused person from a distance of 50metres and if that was true it must have been difficult to identify the accused at night. Secondly Nosizo described how the accused attacked the complainant in her statement but on cross examination she said she was possessed and did not see anything. The court cannot use that statement as evidence," he said.
Dzira added that, "All the witnesses in this case failed to stick to their story. They even gave the court different colours of what the accused was wearing at scene of crime. Without evidence there is no way that this court can incriminate the accused. The accused is therefore found not guilty."
Ndlovu was being accused of raping a married 56-year old Maphisa ZANU PF MP who is blind and was elected under proportional representation.
The MP was allegedly raped at around 2am as she came from Thutshu Night Club in Maphisa last November. She was in the company of Nosizo Ndlovu and Mgcini Mhlophe.
The complainant and her witnesses told the Court that the MP was left at the mercy of the rapist when her two friends got possessed by ancestral spirits and dropped to the ground one after another.
The accused was represented by Prince Bhutshe from Mathonsi Ncube Law Chamber.
