GWERU – A 40-year-old Shurugwi woman who was doing illegal mining and using a letter from Zanu PF that she claimed gave her the required authority to mine has been sentenced to two years in jail.
Instead of the letter vindicating her, it backfired and was used in court by the State to prove that she was actually doing illegal mining.
Sarah Ndzunyayiri was allowed to mine gold without a license in Shurugwi by Zanu PF officials.
Ndzunyayiri who was arrested of mining gold without a license appeared before Magistrate Tendai Madanire and she pleaded not guilty to the charges claiming that Zanu PF officials in Shurugwi gave her a letter which allowed her to mine.
Ndzunyayiri produced the letter in court which she thought was going to clear her name but it was unfortunate for her as the letter was better as State evidence that she was prospecting for gold.
The court immediately told Ndzunyayiri that the case was better off without the claimed Zanu PF letter because the letter had now revealed that she was really prospecting gold without a license because she failed to produce the license.
It is the State's case that on October 22, 2016 at Dzingai homestead four Police constables received tip off to the effect that Ndzunyayiri was prospecting for gold.
The officers reacted to the information and went to the accused person's house where they found crashed gold ore with mercury in a plastic basin mixed with water leading to the arrest of the accused.
The accused in her defence told the court that she had been given a letter by Zanu PF officials so she thought the letter would save her.
She was however slapped with a 2 year jail sentence of which 12 months were suspended for five years on condition she is not involved in such a crime for the next five years. The remaining 12 months were suspended on condition she completes 420 hours of community
