    Respect magistrates’ courts –Gov tells traditional leaders

    A senior Government official has told traditional chiefs that their courts are the lowest on the ladder and they should respect rulings that come from courts above and in particular Magistrates' Courts.
    Permanent Secretary in the Ministry of Justice, Legal and Parliamentary Affairs, Virginia Mabiza warned chiefs against going beyond their areas of jurisdiction. She said the chief's court was the lowest and above it was the Magistrate Court, then the High Court, Supreme Court and the Constitutional Court.
    She said rulings by chiefs can therefore be challenged in the magistrates' courts and reversed and if that happens the chiefs must respect such rulings.
    Mabiza's comments were made during a judicial advocacy meeting which was held at Gweru Polytechnic two weeks ago.
    The meeting had high ranking Government officials including the Minister of Justice, Legal and Parliamentary Affairs, Emmerson Mnangagwa who is also the Vice President.
    Mabiza was answering to a question where Chief Chirumhanzu had asked why Magistrates were undermining and questioning some of the chiefs' judgments.

    Hakuna mukuru asina mukuru wakewo matare edu anongofamba nenzira iyoyo (Chiefs have the jurisdiction to preside over cases brought to their courts but it doesn't end their as there are other superior courts above them, which are the magistrate court followed by the High Court, the Supreme Court and lastly the Constitutional Court. All lower Courts have superior Courts above them)," said Mabiza
    Several chiefs have been sued for their rulings and currently Chief Chirumanzu is facing stocktheft cases at the Magistrates' courts while Chief Nhema of Shurugwi has been dragged to court for impounding a villager's beast.news
