A man from Gwanda has escaped a jail sentence after a local magistrate sentenced him to a fine of $300 for smuggling ammunition components worth R42 855 through the Beitbridge Boarder Post.
Njabulo Nxumalo (31) who works as a cross boarder transporter appeared before Magistrate in charge of Matabeleland South Willard Maphios Maphosa facing a count of smuggling ammunition components in which he pleaded guilty.
Through his defense council, Mr Zibusiso Ncube of Ncube and Partners, Nxumalo said that he was only transporting components which belonged to Mr Clive Connelly of the Dornington Practical Pistol Club based in Bulawayo.
Mr Ncube further said in mitigation that the court ought to be lenient when passing Nxumalo's sentence as he was just transporting the components, it was not him who owned them.
The court heard through Prosecutor, Blessing Gundane that on June 23 this year Nxumalo was travelling from South Africa driving a Toyota Quantaum registration number CF52 LRGP towing a trailer FF05 PYGP which was loaded with various goods.
Nxumalo had completed all the customs of formalities then proceeded to the last check point where they were intercepted by Police details that were on anti-smuggling deployment.
It is further stated that Nxumalo was instructed to proceed to the search bay for re-searching after a suspicion that they had not fully declared their luggage.
Upon searching the vehicle, some goods that were not on the original list were discovered.
The court heard that ZIMRA and police found 20.4kg 9 by 19mm cartridge, 6,4kg Speer cartridge, 2,7kg Federal 40 cartridge, 1kg perfecto 40 cartridge, 3,4kg S and B cartridge, 2,8kg FC 131,4 cartridge, 33,7kg 100mm bullet heads, 32,7kg 9mm bullet heads, 20,8 160FP bullet heads.
The ammunition components were forfeited to the State.
