    Shock as HIV+ sex worker gets community service for sleeping with a minor

    MVUMA – There was drama at the Mvuma Magistrates' Court on Monday when Francisca Mandure, the mother of a 15-year-old form two boy failed to come to terms with a community service sentence handed over to an HIV positive sex worker who had slept with her son.
    Magistrate Vimbai Makora on circuit in Mvuma found HIV positive Beauty Madzinga (19) guilty on her own plea of abusing a form two pupil including having sex with him and sentenced her to 408 hours of community service.
    Mandure who couldn't believe the leniency given to such a serious case broke into tears soon after emerging from the packed court and threatened havoc as she wanted to go and destroy the accused sex worker's property.
    Madzinga and her friend Patience Machoni (19) who both stay in Mushayabvudzi Suburb in Mvuma invited the complainant and another boy who are neighbours into their room and asked them to remove their pants. They fondled and compared the two boys' sex organs trying to establish who had the larger of the two.
    After concluding that the complainant had a bigger manhood, the two sex workers told the other boy (both boys attend school at Leopold Takawira High in Mvuma) to get out as he would not be able to satisfy them. The complainant then had sex with Madzinga while Machoni watched.
    At some stage, Machoni went out to invite the boy with the smaller organ to join her and they both watched as the other pair had sex.
    Although the complainant had sex with Madzinga, he could not sustain another erection to have sex with Machoni.
    The court also heard that the complainant wore a condom when he had sex with Madzinga but his first attempt to put on the condom failed as it burst. He then decided to wear two condom.
    Although Prosecutor Bernard Nyoni told the court that Madzinga's case was an aggravated one because she knew the complainant as his neighbour and knew that he was a school pupil, the Magistrate could not agree with him on his plea for a stiffer sentence.
    Magistrate Makora accepted the submission that she was not aware of her HIV status when she slept with the boy and that she was a first offender.
    Magistrate Makora sentenced the accused to 12 months imprisonment and four months were suspended on condition that she does not commit a similar offence in the next five years and the remaining eight months on condition that she does community service at Gombedze Clinic.
    Magistrate Makora had earlier (Thursday last week) in another trial slapped Madzinga and Machoni with a $120 fine each or 3 months imprisonment in default of payment, after they were found guilty of aggravated indecent assault for fondling the two minors' sex organs.
    "We are sex workers and we earn a living from that. We never thought it was wrong to have sexual intercourse with the boys," Machoni told the court in her defense.
    Madzinga and Majoni were taken to the Chivhu prison on Monday after they failed to pay the $120 fine. news
