Zaka – The wife of Zaka Rural District Council's finance director is suing her husband's girlfriend Juliet Gamasi for US$10 000 for adultery damages.
Elizabeth Machemedze made startling revelations at the Zaka Magistrates' Court that Timothy Machemedze who is the finance director at Zaka has withdrawn all his children from boarding schools after he failed to pay fees because of his love relationship with Gamasi.
She said she has suffered immensely because of that relationship because her husband's lover stays 50 metres away from her place. Machemedze who is represented by Tongai Mutindi of Mupindu Legal Practitioners added that her husband squandered resources including family property as he pampered his girlfriend. She added that she had to endure sleeping in seperate bedrooms with her husband because the marriage had become strained.
The matter was heard by Magistrate Dorothy Mwanyisa.
Although Gamasi conceded in court that she had a relationship with Timothy and has a child out of it, she said she fell for the finance director because he had lied to her that his wife had died. She also said that Timothy was so scruffy, she never thought that he had a wife.
She claimed that the director had even taken her to his parents' home and there was therefore no evidence that Timothy was married.
Machemedze and her husband are married under the Marriage Act, Chapter 5:11 which still subsists.
"I cannot pay such an amount of money because Timothy told me that his wife was dead and I also observed that his dressing did not resemble that of a married person.
"He also introduced me to his parents and his sisters and that made me believe that he was not married," said Gamasi.
However, Machemedze disputed this and told the court that she warned Gamasi several times against getting into a relationship with her husband.
Gamasi told the court that Timothy proposed loved to her in December, 2012 and he told her that his wife's relatives had not collected his late wife's property and they had two children.
In April 2014 the two were blessed with a child.
She said that she cannot pay the $10 000 because she is no longer in love with the husband.
"I'm not formally employed so where do I get that money," asked Gamasi.
The case was postponed to February 3, 2016 for continuation of trial.news
